Nintendo has a new policy in its account user agreement that could be concerning if another Joy-Con stick drift problem happens with the Nintendo Switch 2. The Switch 1 Joy-Cons saw widespread issues with stick drift, a problem that emerges when the console recognizes inputs from the controller stick even if the stick is not being touched. Nintendo won a previous lawsuit in which parents alleged that Nintendo knowingly sold defective controllers. Now, it looks like Nintendo is taking lawsuit-preventative measures for the Switch 2 release.

According to Nintendo's updated End User License Agreement, fans who sign the EULA will be giving up their right to join a class-action lawsuit against the company (via GamesRadar+). This updated user agreement is not specifically directed at potential lawsuits regarding Joy-Con 2 stick drift issues, but the multiple lawsuits that Nintendo faced regarding Joy-Con stick drift during the Switch 1's lifespan could be a reason for the addition. Theoretically, giving up the right to a class-action lawsuit would make that kind of legal response to further stick drift issues impossible.
