Nearly one year after Crush 40 band member Johnny Gioeli sued Sega over Sonic Adventure 2's "Live & Learn" theme song, alleging that Sega was in breach of contract for the song that the band created, and requesting compensation as well as a court order determining who actually owns the rights to the song, the lawsuit has been dismissed.
Even still, the true ownership of the iconic video game song is still unresolved. That's a major blow for Crush 40, as "Live & Learn" continues to be utilized frequently, including in the most recent Sonic live-action movie.
As first reported by Eurogamer, the lawsuit as a whole has been dismissed, but according to Gioeli, the song's true rights "remain in limbo," creating a very awkward situation.
It's worth noting that, per Gioeli, the dismissal has nothing to do with the song's legitimate ownership but rather came as a result based on time. What's more, Gioeli states that he was contacted specifically by Epic Games over whether the song could potentially be used in the rumored Fortnite collaboration with Sonic.
